You have arrived at www.livingcrue.com, which is owned and operated by The Waiting Room Media, LLC, d/b/a Living Crue (“Living Crue”).  Throughout this Privacy Policy the words “we”, “us” and “our” refer to Living Crue, and the words “you” and “your” refer to the user visiting www.livingcrue.com or using the mobile application for accessing www.livingcrue.com (the www.livingcrue.com website (including any mobile version) and any associated mobile application are collectively referred to in this Privacy Policy as the “Site”).  This Privacy Policy applies to information that we collect at the Site and our handling of such information and also to information you provide when you interact with our advertisers, advertising and applications on third-party websites and services, if those applications or advertising include links to this Privacy Policy.  This Privacy Policy does not apply to our data collection activities offline or otherwise outside of the Site (unless otherwise stated below).  Please review the Site’s Terms of Use and, if you are a registered user, the User Agreement, which govern your use of the Site.

By accessing and using our Site, you consent to our Privacy Policy, our Terms of Use and our collection, use and sharing of your information and data, and other activities, as described below.

In order to better provide you with our services and product offerings, we may collect personally identifiable information (“PII”), including:

  • Name

  • Address

  • Email

  • Phone number

If you purchase Living Crue Magazine products and services, we collect billing and credit card information to complete the purchase transaction.

We may also collect, anonymously, demographic information, including:

  • Age

  • Race

  • Gender

Please remember and note that any PII you voluntarily disclose on or through the Site may be collected and used by others. 

We may collect this PII through various forms and in various places on the Site, including account registration forms, “contact us forms”, or when you otherwise upload data to and interact with the Site.

PII you provide to us

Please note that you may be required to provide PII to us to use our products and services. This includes 

  • Registering an account

  • Entering a sweepstakes or promotional campaign or contest by us or one of our partners

  • Signing up for special or exclusive offers by a third party or one of our partners

  • Sending an email message to any of our Waiting Room Media, LLC or Living Crue magazine email addresses

  • Using your credit card information when you purchase or sign up for our products or services.

  • Completing a survey for our research purposes

  • Your search queries on our web sites

We will use your PII to communicate with you in relation to the services or products you have requested from us or about which you have contacted us. We may request to collect additional PII from you in the future.

You also may provide PII to be published or posted on public areas of the Site, or transmitted to other users of the Site or third parties. Your content is posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your posts and content in public spaces will not be viewed by unauthorized persons.

Children

The Site is not intended for children under 16 years of age. We do not knowingly collect PII from children under 16. If we become aware that such data has been collected, we will delete it. PII directly from children under the age of 16 is generally obtained through parental consent. A child’s parent or guardian may also request that the PII of their child be deleted from our records by emailing us at: info@livingcrue.com.

PII We Collect Through Automatic Data Collection Technologies.

As you navigate through and interact with the Site, we and our third-party service providers may use a variety of technologies that automatically (or passively) store or collect certain information whenever you visit or interact with the Site (“Usage Information”).  This Usage Information may be stored or accessed using a variety of technologies that may be downloaded to your personal computer, browser, laptop, tablet, mobile phone or other device (a “Device”) whenever you visit or interact with our Site.  To the extent we associate Usage Information with PII we collect directly from you on the Site, we will treat it as PII.

This Usage Information may include:

  • your IP address, UDID or other unique identifier (“Device Identifier”). A Device Identifier is a number that is automatically assigned to your Device used to access the Site, and our computers identify your Device by its Device Identifier;

  • your Device functionality (including browser, operating system, hardware, mobile network information);

  • the URL that referred you to our Site;

  • the areas within our Site that you visit and your activities there, including remembering you and your preferences;

  • your Device location;

  • your Device characteristics; and

  • certain other Device data, including the time of day, among other information.

Tracking Technologies.  We may use various methods and technologies to store or collect Usage Information (“Tracking Technologies”).  Tracking Technologies may set, change, alter or modify settings or configurations on your Device. A few of the Tracking Technologies include, without limitation, the following (and subsequent technology and methods later developed):

Cookies.  A cookie is a data file placed on a Device when it is used to visit the Site.  A Flash cookie (or locally shared object) is a data file placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device.  HTML5 cookies can be programmed through HTML5 local storage.

Web Beacons.  Small graphic images or other web programming code called web beacons (also known as “1x1 GIFs” or “clear GIFs”) may be included in our Site’s pages and messages.  Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or e-mail can act as a web beacon.  Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Site, to monitor how users navigate the Site, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed.  

Embedded Scripts.  An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on.  The code is temporarily downloaded onto your Device from our web server or a third-party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.  

Browser Fingerprinting.  Collection and analysis of information from your Device, such as, without limitation, your operating system, plug-ins, system fonts and other data, for purposes of identification.  

ETag, or Entity Tag.  A feature of the cache in browsers.  It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL.  If the resource content at that URL ever changes, a new and different ETag is assigned.  Used in this manner ETags are a form of Device Identifier.  ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and/or HTML5 cookies.  

Recognition Technologies.  Technologies, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices in the same user).

Tracking Technologies Usage.  We may use Tracking Technologies for a variety of purposes, including:

Strictly Necessary.  We may use cookies or other Tracking Technologies that we consider are strictly necessary to allow you to use and access our Site, including cookies required to prevent fraudulent activity and improve security.  

PerformanceRelated.  We may use cookies or other Tracking Technologies that are useful in order to assess the performance of the Site, including as part of our analytic practices or otherwise to improve the content, products or services offered through the Site.  

FunctionalityRelated.  We may use cookies or other Tracking Technologies that are required to offer you enhanced functionality when accessing the Site, including identifying you when you signin to our Site or keeping track of our specified preferences, including in terms of the presentation of content on our Site.  

  1. TargetingRelated. We may use Tracking Technologies to deliver content relevant to your interests on our Site and thirdparty sites based on how you interact with our content. This includes using Tracking Technologies to understand the usefulness to you of the content that has been delivered to you.

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Living Crue services or websites you visit.

The Usage Information helps us to improve the Site and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize our websites according to your individual interests.

Tracking Technologies Choices and Consent.

We obtain your consent to our information storage or collection Tracking Technologies by providing you with transparent information in our Privacy Policy and providing you with the opportunity to make a choice to disable cookies as set forth above.  Please note that we are not required to obtain your consent to the information collection Tracking Technologies identified above that are strictly necessary.

We are giving you detailed notice of the Tracking Technologies and your limited choices regarding them so that your consent is meaningfully informed.

Third Party Tracking and “Do Not Track.”

There may be other Tracking Technologies now and later devised and used by us in connection with the Site.  Further, third parties may use Tracking Technologies in connection with our Site, which may include the collection of information about your online activities over time and across third-party websites or online services.  We may not control those Tracking Technologies and we are not responsible for them.  However, you consent to potentially encountering third-party Tracking Technologies in connection with use of our Site and accept that our statements under this Privacy Policy do not apply to the Tracking Technologies or practices of such third parties.  Also, various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party web sites or online services (e.g., browser do not track signals).  Currently, we do not monitor or take any action with respect to these signals or other mechanisms.

Information Third Parties Provide About You

We may, from time to time, supplement the information we collect directly from you on the Site with outside records from third parties for various purposes, including to enhance our ability to serve you, to tailor our content to you and to offer you opportunities that may be of interest to you.  To the extent we combine information we receive from those sources with your PII we collect on the Site, it will be treated as PII and we will apply this Privacy Policy to such combined information, unless we have disclosed otherwise.  In no other circumstances do our statements under this Privacy Policy apply to information we receive about you from third parties, even if they have used our technology to collect it and share it with us.

Interactions with Third-Party Sites 

The Site may include functionality that allows certain kinds of interactions between the Site and a third-party website or application.  The use of this functionality may involve the third-party operator providing certain information, including PII, to us.  For example, when you register with the Site, you may have an option to use your Facebook, Google or other account provided by a third-party site or application to facilitate the registration and log-in or transaction process on the Site, or otherwise link accounts.  If we offer and you choose to use this functionality to access or use our Site, the third-party site or application may send PII about you to us.  If so, we will then treat it as PII under this Privacy Policy, since we are collecting it as a result of your accessing of and interaction on our Site. In addition, we may provide third-party sites’ interfaces or links on the Site to facilitate your sending a communication from the Site.  For example, we may use third parties to facilitate emails, tweets or Facebook postings.  These third parties may retain any information used or provided in any such communications or other activities and these third parties’ practices are not subject to our Privacy Policy.  Living Crue may not control or have access to your communications through these third parties.  Further, when you use third-party websites or services, you are using their services and not our services and they, not we, are responsible for their practices.  You should review the applicable third-party privacy policies before using such third-party tools on our Site.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any PII:

  • To present our websites and its contents to you.

  • To provide you with information via email about new Living Crue product or service offerings on an ongoing basis, unless you opt out of receiving such emails

  • To fulfill any other purpose for which you provide it.

  • To send promotional or marketing emails to you on behalf of the other businesses or organizations;

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To improve the Site, to create new service offerings, to customize your experience on the Site, or to serve you specific content that is most relevant to you;

  • To notify you about changes to our websites or any products or services we offer or provide though it.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

We may also use your information to contact you about goods and services that may be of interest to you. If you do not want us to use your information in this way, please check the relevant box located on the form on which we collect your data.

Sharing Information with Third Parties 

Living Crue does not sell, rent or lease PII to third parties. 

We may, however, share information that is not PII, such as aggregated user statistics and browsing behavior information, with third parties.  We may share the information we have collected, including PII, as disclosed at the time you provide the information and as described below or otherwise in this Privacy Policy.  

We may also disclose PII as follows:

  • When You Request Information From or Provide Information to Third Parties. You may be presented with an option on our Site to receive certain information and/or marketing offers directly from third parties or to have us send certain information to third parties or give them access to it. If you choose to do so, your PII and other information may be disclosed to such third parties and all information you disclose will be subject to the third-party privacy policies and practices of such third parties.

  • Third Parties Providing Sites on Our Behalf. We may use third-party vendors to perform certain services on behalf of us or the Site, such as hosting the Site, designing and/or operating the Site’s features, tracking the Site’s activities and analytics, and enabling us to send you special offers or perform other administrative services. We may provide these vendors with access to user information, including Device Identifiers and PII, to carry out the services they are performing for you or for us. Third-party analytics and other service providers may set and access their own Tracking Technologies on your Device and they may otherwise collect or have access to PII. We are not responsible for those third-party technologies or activities arising out of them, nor are we responsible for the effectiveness of or compliance with any third parties’ opt-out options.

  • To Protect the Rights of Living Crue and Others. To the fullest extent permitted by applicable law, we may also disclose PII if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Living Crue or third parties (including through the enforcement of this Privacy Policy, our Terms of Use, the User Agreement or other applicable agreements and policies); or (ii) comply with legal and regulatory obligations (e.g., pursuant to law enforcement inquiries, subpoenas or court orders). To the fullest extent permitted by applicable law, we have complete discretion in electing to make or not make such disclosures, and to contest or not contest requests for such disclosures, all without notice to you.

  • Affiliates and Business Transfer. We may share PII with our parent, subsidiaries and affiliates. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Site or applicable database; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and/or assets or other corporate change, including, during the course of any due diligence process.

 

Opt-Out of Disclosure of PII to Third Parties 

In connection with any PII we may disclose to a third party for a business purpose, you have the right to know: 

• The categories of PII that we disclosed about you for a business purpose. 

If you are a California resident, you might have the right under the California Consumer Privacy Act of 2018 (CCPA) and certain other privacy and data protection laws, as applicable, to opt-out of the disclosure of your PII. If you exercise your right to opt-out of the disclosure of your PII, we will refrain from disclosing your PII, unless you subsequently provide express authorization for the disclosure of your PII. Links 

The Site may contain content that is supplied by a third party, and those third parties may collect Usage Information and your Device Identifier when pages from the Site are served to you.  In addition, when you are on the Site you may be directed to other services that are operated and controlled by third parties that we do not control.  We are not responsible for the data collection and privacy practices employed by any of these third parties or their services and they may be tracking you across multiple sites and may be sharing the results of that tracking with us and/or others.  For example, if you “click” on a link, the “click” may take you off the Site onto a different site.  These other sites may associate their Tracking Technologies with you, independently collect data about you or others, including PII, and may or may not have their own published privacy policies.  We encourage you to note when you leave our Site and to review the third-party privacy policies of all third-party websites and exercise caution in connection with them.  

Security of your PII 

Living Crue secures your PII from unauthorized access, use, or disclosure. Living Crue uses the following methods for this purpose: 

  • SSL Protocol

When PII (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol. 

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your PII. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed. 

Right to Deletion 

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will: 

  • Delete your PII from our records; and

  • Direct any service providers to delete your PII from their records.

  Please note that we may not be able to comply with requests to delete your PII if it is necessary to: 

  • Complete the transaction for which the PII was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

  • Debug to identify and repair errors that impair existing intended functionality;

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

  • Comply with the California Electronic Communications Privacy Act;

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

  • Comply with an existing legal obligation; or

  • Otherwise use your PII, internally, in a lawful manner that is compatible with the context in which you provided the information.

  

Opt-Out & Unsubscribe from Third Party Communications 

We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from third-party partners of Living Crue by contacting us at info@livingcrue.com.  

E-mail Communications 

From time to time, Living Crue may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from Living Crue or click on a link therein. 

If you would like to stop receiving marketing or promotional communications via email from Living Crue, you may opt out of such communications by Customers may unsubscribe from emails by "replying STOP" or clicking on the “UNSUBSCRIBE” hypertext link within the email.

External Data Storage Sites 

We may store your data on servers provided by third party hosting vendors with whom we have contracted. 

Transfer of Information to the United States

Our Site is operated in the United States.  If you are located outside of the United States, please be aware that information we collect, including PII, will be transferred to, and processed, stored and used in the United States.  The data protection laws in the United States may differ from those of the country in which you are located, and your PII may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States.  By using the Site or providing us with any information, you consent to the transfer to, and processing, usage, sharing and storage of your information, including PII, in the United States as set forth in this Privacy Policy.  

Changes to this Privacy Policy 

Living Crue reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat PII by sending a notice to the primary email address specified in your account, by placing a prominent notice on our website, and/or by updating any privacy information. Your continued use of the website and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
